Draft. This page has not yet been reviewed by legal counsel and will change before launch.

About these terms

These terms apply to your use of this website, run by Qualsted ("we", "us"). By using it you agree to them. If you don't agree, please don't use the website. [Legal entity name and registered address to confirm with counsel.]

They do not cover the Qualsted software itself. Using the software, and any trial or evaluation of it, is governed by a separate written agreement between you or your organization and us, which controls if it differs from anything here.

What the website is for

It describes Qualsted and lets you ask us about it, for example to book a demo. The information on it is general and is provided in good faith, but it is not a contract, an offer, or a promise of a particular result. Features, prices and availability can change, and the website may lag behind. Where a price or feature matters to your decision, confirm it with us in writing.

Not legal or regulatory advice

The website, including its guides, discusses regulations and standards such as 21 CFR Part 11, EU GMP Annex 11 and ISO 13485. It explains how our software supports them. It is not legal, regulatory or compliance advice. Whether your organization complies with a regulation depends on your own procedures, validation and judgment: check current requirements and get qualified advice for your situation. We make no statement that using Qualsted makes any organization compliant or certified.

Our content and your use of it

The website's text, images, screenshots, videos, logo and design belong to us or our licensors and are protected by law. You may view it and share links to it, and you may quote short extracts with credit to us. You may not copy, republish, sell or build on it without our written permission. "Qualsted" and its logo are our marks. Screens shown on the website use sample data from fictional companies; any resemblance to a real organization or person is coincidental.

Using the website properly

Please don't use the website to break the law, to send us anything harmful or misleading, to probe or disrupt it or its security, to collect its content by automated means beyond what a normal search engine does, or to pretend to be someone else. If you find a security problem, please tell us at security@qualsted.com rather than exploiting it.

What you send us

When you send us a request or a message, please give accurate details and do not include confidential, regulated or personal information about other people. We handle what you send as described in our Privacy Policy. Anything you send us as an idea or suggestion may be used by us without obligation to you.

Links to other sites

The website links to other sites, such as regulators and standards bodies. We don't control them and are not responsible for their content or practices.

No warranty

The website is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including that the website will be uninterrupted, error-free or free of harmful components, and any implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Limit of our responsibility

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the website or reliance on its content. Our total liability for any claim relating to the website is limited to [amount to be set by counsel]. Nothing here limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.

Changes

We may change the website and these terms. The version on this page, with its date, is the one that applies. Continuing to use the website after a change means you accept it.

These terms are governed by the laws of [governing law and venue to be set by counsel], without regard to its conflict-of-laws rules, and the courts there have exclusive jurisdiction, except where your local law gives you rights that cannot be waived.
